Welcome to hikeshifoundation.com (the “Site”), operated by Hikeshi Foundation Inc. (“Hikeshi Foundation,” “we,” “us,” or “our”), a Delaware nonprofit corporation. By using the Site or making a donation, you agree to these Terms of Use (“Terms”) and to our Privacy Policy. If you do not agree, please do not use the Site.

1. About us

Hikeshi Foundation is a family-led nonprofit organized exclusively for charitable, scientific, and educational purposes. We raise funds for research toward a treatment for HIKESHI-related leukodystrophy (HLD13), support affected families, and raise awareness of the disease. We are a charitable organization, not a medical provider, research institution, or professional adviser.

2. Not medical advice

The Site provides general information about HIKESHI-related leukodystrophy, related research, and the foundation’s work. Nothing on the Site is medical advice, and it is not a substitute for consultation with a qualified physician or genetic counselor who knows your child’s situation.

  • Information about research, therapies, clinical trials, or scientific findings is provided for general awareness and may be incomplete, preliminary, or out of date. Research summaries reflect our understanding at the time of writing and may not reflect scientific consensus.
  • We do not endorse any specific treatment, clinical trial, physician, institution, or product, and a mention on the Site is not a recommendation.
  • Never delay, change, or discontinue medical care because of something you read on the Site. If you think your child may have a medical emergency, contact your doctor or emergency services immediately.

3. Donations

  • Voluntary and charitable. Donations are voluntary contributions to support our mission. You receive no goods or services in return, unless expressly stated for a specific event or campaign.
  • Use of funds. We use donations at our discretion in furtherance of our charitable purposes, including research grants, family support, awareness, and reasonable operating costs. Where a donation is designated for a specific purpose, we will honor that designation where reasonably possible; if it becomes impossible or impractical, we will use the funds for a purpose as close as reasonably possible to the donor’s intent.
  • Payment processing. Donations are processed by Stripe, Inc. under Stripe’s terms of service. We do not store your full payment card details. All donations are in U.S. dollars unless otherwise indicated; your card issuer may apply conversion fees.
  • Recurring donations. If you choose a monthly gift, you authorize us to charge your payment method each month until you cancel. You may cancel at any time by contacting us. Cancellation takes effect for the next scheduled charge.
  • Refunds. Donations are generally non-refundable. If you believe a donation was made in error, in the wrong amount, or without authorization, contact us within 30 days and we will review the request in good faith. Refunds are issued to the original payment method.
  • Receipts. You will receive an email receipt for each donation. Please keep it for your records.
  • Tax status. Hikeshi Foundation Inc. is a Delaware nonprofit corporation. Our application for recognition as a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code is in process with the IRS. If approved, exemption is expected to be retroactive to our date of incorporation, July 22, 2026, which would make donations made in the meantime deductible to the extent permitted by law. Until the IRS issues its determination, we cannot guarantee that your donation is tax-deductible. We make no representation about the tax treatment of your gift in any jurisdiction; please consult your own tax adviser. We will notify donors when our status is determined.

4. Your submissions

If you send us a message, story, photo, testimonial, or other content (“Submission”):

  • You confirm that you have the right to share it and, where it includes information about or images of another person, including a child, that you are that person’s parent or legal guardian or have their permission.
  • Submissions intended for publication will be published only with your explicit written consent, which you may withdraw at any time as described in our Privacy Policy.
  • Where you consent to publication, you grant Hikeshi Foundation a non-exclusive, royalty-free, worldwide license to reproduce, display, and distribute the Submission on the Site, in our communications, and in fundraising and awareness materials, in furtherance of our charitable mission, until you withdraw consent. You retain all ownership of your Submission.
  • We may edit Submissions for length or clarity and may decline to publish any Submission.
  • Please do not send medical records unless we have specifically asked for them.

5. Intellectual property

The Site and its content — including text, the foundation’s name and logo, photographs, graphics, and design — are owned by Hikeshi Foundation or used with permission and are protected by copyright and trademark law. You may view, download, and print pages for personal, non-commercial purposes, and you may share links to the Site. You may not copy, modify, republish, or use our name, logo, or content for any other purpose without our prior written permission. Scientific information referenced on the Site may belong to third parties and is credited where applicable.

6. Acceptable use

You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to the Site, its servers, or the donation system; make fraudulent donations or use payment methods you are not authorized to use; upload malicious code; scrape or harvest information from the Site; impersonate the foundation or any person; or use the Site to harass, defame, or harm anyone, including families featured on the Site. We may restrict or terminate access to anyone who violates these Terms.

7. Third-party links and services

The Site may link to third-party websites, research publications, patient registries, or clinical trial listings. These are provided for convenience only. We do not control and are not responsible for their content, accuracy, availability, or privacy practices, and a link is not an endorsement.

8. Disclaimers

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any research described will lead to a treatment.

9. Limitation of liability

To the fullest extent permitted by law, Hikeshi Foundation and its directors, officers, volunteers, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, arising out of or relating to your use of the Site, any content on it, or any donation. Our total liability for any claim relating to the Site or a donation will not exceed the amount of the donation giving rise to the claim or one hundred U.S. dollars ($100), whichever is greater. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Hikeshi Foundation and its directors, officers, volunteers, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your Submissions, or your misuse of the Site.

11. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. Nothing in this Section prevents either party from seeking injunctive relief in any court of competent jurisdiction, and nothing limits any mandatory consumer rights you may have under the laws of your country of residence.

12. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a new effective date, and your continued use of the Site after that date constitutes acceptance. Donations are governed by the Terms in effect at the time the donation is made.

13. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and Hikeshi Foundation regarding the Site. You may not assign your rights under these Terms; we may assign ours to a successor organization in furtherance of our charitable mission.
